Roxamina (“we,” “our,” or “us”) is the owner and operator of the website www.roxamina.com and any related platforms (collectively referred to as the “Service”). The following are the Terms and Conditions of Use (“Terms”) that govern your use of the Service. By purchasing or accessing our courses, digital downloads, or any related content (“Products”), you expressly agree to be bound by these Terms and our Privacy Policy, and to comply with all applicable laws and regulations.

We reserve the right to change these Terms at any time. Updates will be posted on this page and become effective immediately. You agree that it is your responsibility to review the Terms periodically, and your continued use of the Service constitutes acceptance of any modifications.

Accessing Content and Downloads

  • All video course content is viewable online via streaming once you are logged into your account. Video content is not downloadable.

  • Other content such as PDF files, guides, presets, or digital products may be made available for download where specified.

  • Purchases are for individual use only. Sharing, transferring, or redistributing your login credentials or downloaded materials is strictly prohibited.

Payment Plans

By purchasing a payment plan, you expressly authorize us to charge your designated payment method for the agreed installment amounts according to the schedule shown at checkout.

Failed Payments

  • If a payment fails, you will be notified and must update your payment information within 7 days. Access to the purchased program will remain active during this grace period.

  • If the payment is not successfully completed within 7 days, your access will be suspended until the outstanding balance is resolved.

  • If payment is not resolved within 14 days, your access may be permanently revoked, and you will forfeit any installments already paid

By enrolling in a payment plan, you agree to complete all required payments. If you experience issues, you must contact us at info@roxamina.com for assistance.

Automatic Renewal Terms (Subscriptions)

If you purchase a subscription, you agree to recurring charges at the rate and billing frequency selected at checkout (monthly, bi-annual, or annual). You accept responsibility for all recurring payments until you cancel your subscription.

  • Subscription charges will be processed automatically each billing cycle.

  • Charges will continue until you cancel in accordance with our Cancellation Policy.

Cancellation Policy

You may cancel your subscription at any time by logging into your account, selecting “Cancel Subscription,” and confirming the cancellation.

  • Cancellations take effect at the end of the current billing cycle.

  • No refunds will be issued for subscription fees already paid.

  • Despite cancellation, you will retain access to purchased content until the end of your paid billing period.

Service Content & Copyright Protection

The Service and all associated content, including but not limited to text, software, scripts, graphics, photos, videos, sound recordings, course materials, guides, digital downloads, presets, and logos (collectively, “Service Content”), are the intellectual property of Roxamina and/or our licensors. All rights are reserved under United States copyright law and international treaties.

You agree that:

  • Service Content is provided for your personal, non-commercial use only.

  • You may not copy, reproduce, distribute, modify, publish, transmit, display, perform, resell, or exploit Service Content in any form.

  • You may not upload, share, or redistribute our Content on file-sharing sites, forums, social media, or any other medium.

  • You may not use our Content to create derivative works, training programs, or competing products.

  • If you download permitted materials (e.g., PDFs, presets), you must retain all copyright and proprietary notices.

Enforcement

We actively monitor for copyright infringement. Unauthorized use of our Content may result in:

  • Immediate termination of your access without refund.

  • Legal action for damages, including recovery of attorney’s fees, statutory damages under the U.S. Copyright Act, and injunctive relief.

  • Reporting of infringement under the Digital Millennium Copyright Act (DMCA).

By purchasing from Roxamina, you agree to respect our intellectual property rights and acknowledge that violation of this section may result in serious legal and financial consequences.

Registration & Accounts

To access certain parts of the Service or purchased content, you may be required to create an account by providing your name, email address, and other necessary information (“Account Information”). You agree to:

  • Provide accurate and up-to-date information.

  • Maintain the confidentiality of your login credentials.

  • Be solely responsible for all activity under your account.

You may not use false information, impersonate another person, or share your account credentials. We reserve the right to verify your identity and may suspend or terminate accounts that provide false or misleading information.

By providing your email, you consent to receiving Service-related communications (such as order confirmations, updates, or policy notices). You cannot opt out of Service-related emails but may opt out of promotional emails.

We do not endorse or guarantee the offerings of any third-party advertisers or sponsors, and your business dealings with them are entirely at your own risk.  

Warranties & Disclaimers

The Service and Content are provided “as is” without warranties of any kind, express or implied. We do not guarantee that:

  • The Service will be uninterrupted, secure, or error-free.

  • Course content will meet your expectations or desired outcomes.

  • Files or downloads will be free of viruses or harmful components.

To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law:

  • Roxamina, its owners, employees, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages, including lost profits or data, arising from your use of the Service.

  • Our total liability to you for any claim shall not exceed the amount you paid to us in the 12 months prior to the event giving rise to the claim.

  • Multiple claims will not increase this limit.

Dispute Resolution & Governing Law

Any disputes arising from these Terms or your use of the Service will be resolved under the laws of the State of [Your State], without regard to its conflict-of-law principles.

You agree that:

  • Disputes will first attempt to be resolved informally by contacting us at info@roxamina.com.

  • If unresolved, disputes shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Rules.

  • Arbitration shall take place in [Your State/City], unless both parties agree otherwise.

  • You waive any right to participate in a class action or jury trial.

Right to Manage the Service & to Terminate Users  

We reserve the right, but do not have the obligation, to:  

Monitor the Service for violations of these Terms.  

Take appropriate legal action against anyone who violates these Terms, including reporting violations to law enforcement.  

Restrict or disable access to any account or portion of the Service that we determine, in our sole discretion, may be harmful, unlawful, or in violation of these Terms.  

Remove or limit access to content that we believe infringes on intellectual property rights or otherwise violates applicable law.  

Manage the Service in a way that protects our rights, property, and the rights and safety of other users.  

WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS, WE RESERVE THE RIGHT TO DENY ACCESS TO AND USE OF THE SERVICE TO ANY PERSON, FOR ANY REASON OR NO REASON, AT OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY. Termination for violations will not entitle you to any refund.  

No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

No Warranties

EXCEPT AS OTHERWISE REQUIRED BY LAW, THE SERVICE, INCLUDING ALL CONTENT THEREIN, IS PROVIDED “AS IS.” WE AND OUR SUPPLIERS DISCLAIM ANY AND ALL REPRESENTATIONS AND WARRANTIES WITH RESPECT TO THE SERVICE, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We cannot and do not guarantee any specific results from use of the Service. Without limiting the foregoing, we do not represent or warrant that:

  • The software, content, or materials provided are accurate, complete, reliable, current, or error-free.

  • The Service will be available at any particular time or location, uninterrupted or secure.

  • Any defects or errors will be corrected.

  • The Service or its servers are free of viruses or other harmful components.

Limitation of Liability

IN NO EVENT WILL WE, OR OUR DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR SUPPLIERS, BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF YOUR USE OF THE SERVICE OR ANY CONTENT OBTAINED THROUGH IT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, REGARDLESS OF THE FORM OF THE ACTION, SHALL BE LIMITED TO THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM. THIS IS AN AGGREGATE LIMIT; THE EXISTENCE OF MORE THAN ONE CLAIM WILL NOT INCREASE THIS LIMIT.

Entire Agreement

These Terms & Conditions, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Roxamina regarding your use of the Service.

Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. Section headings are for convenience only and have no legal effect.

If any provision of these Terms is found unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
